Terms of Service

1. Service Description

FreeCity VPN is a virtual private network service allowing users to route internet traffic through an encrypted tunnel to a VPN exit node in a chosen geographic location. The Service is available as client applications for Android, Windows, and via the web cabinet.

2. Eligibility

• Only persons aged 18 or older may use the Service.
• You represent that you have the legal capacity to enter into this agreement.
• Use of the Service in jurisdictions where such services are prohibited by law is at your own risk; we accept no responsibility for your violation of local law.

3. User Account

For full use of the Service you register an account with an email address and password. You agree to:

Provide accurate information at registration.

Keep your password secure and not share it with third parties.

Promptly notify us of any unauthorized access to your account.

Not create multiple accounts to bypass device or subscription limits.

The anonymous trial (no registration) is granted for 30 days and tied to the app installation identifier; attempts to bypass this limit by repeated installations may result in blocking.

4. Acceptable Use Policy

You agree not to use the Service for any of the following activities ("Prohibited Activities"):

4.1. Prohibited Activities

• Any activity that violates the laws of the Russian Federation, the EU, the USA, or another applicable jurisdiction.
• Unauthorized access to computer systems, hacking attacks, port scanning of others' systems without permission.
• Distribution of malware, phishing pages, exploits.
• Sending spam (unsolicited bulk messages) via email, messengers, forums.
• Copyright and related-rights infringement (including distribution of pirated content, torrenting of copyrighted material without proper licenses).
• Creation, distribution, or storage of child sexual abuse material (CSAM).
• Resale or transfer of access to the Service to third parties without the Company's written consent.
• Actions aimed at disrupting the Service (DDoS attacks on our nodes, exploitation of vulnerabilities, reverse engineering of protocols to bypass limitations).
• Use of the Service for commercial activities requiring licensing (banking, gambling in unregulated jurisdictions) without coordination with the Company.

4.2. Consequences of Violations

Upon identification of Prohibited Activities, the Company may, without prior notice, suspend or terminate your access to the Service, revoke your account, delete associated data, and if necessary transfer information to law-enforcement authorities in accordance with applicable law. Refunds will not be issued in such cases.

5. Subscriptions and Payment

Basic Service functionality is available free of charge (FREE tier) with limits on the number of regions and devices.

Extended functionality is available via the paid PRO_5 (5 regions) and PRO_10 (10 regions) subscriptions. Pricing and terms are listed on the pricing page.

Payment is processed through the YooMoney payment provider. Your card details are processed exclusively by YooMoney; we do not receive or store them.

Subscriptions are paid monthly. Automatic renewal is not implemented in the current version of the Service: to extend your subscription, you must manually pay for the next period before the current one expires.

Refunds are governed by a separate Refund Policy (/refund).

6. Service Availability

We make reasonable efforts to maintain continuous Service operation but do not guarantee absolute availability. The Service may be temporarily unavailable due to maintenance, incidents at our infrastructure providers, regulatory blocking in specific jurisdictions, or other circumstances beyond our reasonable control.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available". To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to warranties of fitness for a particular purpose, conformity to description, non-infringement of third-party rights, uninterrupted operation, and absolute security.

8. Limitation of Liability

To the maximum extent permitted by applicable law, the Company is not liable for any indirect, incidental, special, punitive, or consequential damages arising from the use or inability to use the Service. The Company's aggregate liability for any claims related to the Service is limited to the amount you actually paid for the Service over the 12 months preceding the event giving rise to the claim.

9. Indemnification

You agree to indemnify the Company against any damages, claims, fines, and legal costs arising from your breach of these Terms, the Acceptable Use Policy, or applicable law in connection with your use of the Service.

10. Intellectual Property

Software, trademarks, design, documentation, and other intellectual-property assets related to the Service belong to the Company or its licensors and are protected by intellectual-property law. Use of the Service does not transfer any rights in these assets to you, other than a limited, revocable, non-exclusive right to use the client applications for their intended purpose.

11. Termination

You may terminate use of the Service at any time by deleting your account via the user cabinet or by support request. We may suspend or terminate your access to the Service for breach of these Terms, upon law-enforcement request, or on other grounds provided by applicable law. Following termination, your data is processed in accordance with the Privacy Policy.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction where the Company is registered. Any disputes arising from or related to these Terms shall be resolved in the courts of the relevant jurisdiction, unless otherwise expressly required by applicable consumer-protection law.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date and, where possible, communicated via email or within the Service at least 14 days before they take effect. Continued use of the Service after the changes take effect constitutes your acceptance of the updated Terms.
